The Kumasi High Court (High Court 5) has dismissed an injunction application filed by Akosua Serwaa Fosu, who sought to restrain the family of the late highlife icon, Charles Kwadwo Fosu, popularly known as Daddy Lumba, from accessing his body until an ongoing legal dispute is resolved.
Presided over by Her Ladyship Justice Mrs. Dorinda Smith Arthur, the court explained that there was no need to grant the injunction since it would deliver its ruling on November 25, 2025 well before the planned final funeral rites scheduled for December 6, 2025, at the Baba Yara Sports Stadium in Kumasi.
During its second hearing, the court also considered a preliminary motion challenging the plaintiff’s capacity to institute the suit. However, counsel for the defendants, Lawyer Fati Ali Alha, withdrew the motion, leading the court to strike it out and allow the substantive case to continue.
The case originates from a suit filed by Akosua Serwaa Fosu on October 3, 2025, against Kofi Owusu Fosu, head of Daddy Lumba’s external family, and Priscilla Ofori Atta, popularly known as “Odo Broni.” In her writ, Akosua Serwaa is seeking a declaration that she is the lawful surviving spouse of the late musician and, therefore, the only person entitled to perform widowhood rites at his funeral.
The celebrated musician passed away on July 26, 2025. His extended family has since announced plans to hold his final funeral rites on December 6, 2025. Akosua Serwaa, however, maintains that neither she nor her children were consulted in the planning and that she only learned of the arrangements through social media.
